You acknowledge and agree that by clicking on "I accept" on behalf of an individual or organisation (the "User" “Teacher (Candidates)”, “Recruiter (Organization)”), you agree that the individual or organisation will be bound by these terms as a User. You warrant and represent that you have full capacity and authority to enter into these Terms on behalf of the individual or organisation.
By using this Site, and further by registering to use our Service, you ("You, user, Recruiter or Candidates") agree that you are at least 18 years of age and are agreeing to accept and comply with the terms and conditions of use stated below ("Terms of Use"). You should read the entire Terms of Use carefully before you use this web site ("Site") or any of the services of this Site.
For the performance of the agreement, the Recruiter agree to pay a subscrption Fee, to access and post job offers on the site, The Moving Teacher shall provide the user with the services as described on the Website, which allow users to navigate, view job offers, apply for job openings and post job ads ("Services") on the website. The Services typically include the following:

Subject to the terms of this agreement, The Moving Teacher hereby grants you a limited, non-exclusive, personal, non-sublicensable, non-assignable license to use the Site and the Service, which may only be used in connection with The Moving Teacher Service and in accordance with this Terms and conditions and any rules, restrictions or documentation set forth by The Moving Teacher from time to time.
You agree that you will not, in connection with your use of the Site or the Service, violate any applicable law, ordinance, rule, regulation or treaty. Without limiting the foregoing, you agree that you will not make available through the Site or the Service any material or information that infringes any copyright, trademark, patent, trade secret, or other right of any party (including rights of privacy or publicity).
In order to use the Services, the user agree to register with The Moving Teacher by completing the online registration form on the Website.
i. The Moving Teacher shall send the user a confirmation email ("Confirmation Email") once it has accepted and confirmed the user’s registration. The user contract to use the Services on these Terms ("Contract") commences on the date of the Confirmation Email.
ii. The Moving Teacher reserves the right to verify the user information, by requesting means of identification to confirm your identity If The Moving Teacher has reason to believe that the information provided by the user to register and use any of the Services breaches or is likely to breach any of the provision in these Terms, The Moving Teacher at its sole discretion may take any action that it deems appropriate including without limitation, to terminating the users account.
These Terms shall apply to any and all users who access and use the Website and the Services through the user account.
Subject to the express provisions of these terms and conditions. All trademarks, logos, and service marks ("Marks") displayed on the website are The Moving Teacher property. You are not permitted to use these Marks without our prior written consent of The Moving Teacher.
Unless otherwise specified in these Terms, all Materials, including the Intellectual property in the Services, are our sole property or the property of our licensors. The Services are available only to individuals who are 18 years or above and can enter into a legally binding agreement under the United State laws.
We provide certain Subscription services (paid Services), where users will pay a fee to access or view some part of the website features. Accordingly, you acknowledge that, The Moving Teacher will charge you a fee according our Subscription Policy in exchange for your right to have access and use our products and services in accordance with these Terms (“the Subscription Service (s)”).
You authorize us and our third party payment processor to credit or charge your payment card for any purchase made on the Site. Please be aware that we do not directly collect credit card information from you, but through our authorized third-party payment processor, please refer to their privacy policy.
We may cancel a payment or prevent you from initiating a purchase for any reason, including, without limitation, the following: (i) if you attempt to use the Services in breach of any applicable law collective bargaining agreement or regulation, including the card network rules or regulations; (ii) if you use the Services in breach of these Terms; (iii) if we suspect fraudulent, unlawful or improper activity regarding a payment; (iv) if we detect, in our sole discretion, that your payments have excessive disputes, high reversal rates or present a relatively high risk of losses; or (v) failure to cooperate in an investigation or provide additional information when requested.
We ask you both users to be respectful to each other during your use of The Moving Teacher Services. Avoid using foul language or creating a muss during communication. The Moving Teacher reserve the right to terminate or suspend a user account, even after purchasing a product or services on the site. In these circumstances, no refund will be considered.
Our Service contains links to third-party websites, offers, services and resources (collectively “Third-Party Services”) that are not under our control. We provide these links only as a convenience and are not responsible for the content, products or services that are available from Third-Party Services. You acknowledge sole responsibility and assume all risk arising from your use of any Third-Party Services.
The materials appearing on The Moving Teacher's website could include technical, typographical, or photographic errors. The Moving Teacher does not warrant that any of the materials on its website are accurate, complete or current. The Moving Teacher may make changes to the materials contained on its website at any time without notice. However The Moving Teacher does not make any commitment to update the materials.

x. create computer viruses or implement any form of software or scripts onto the Website that have the appearance of coming from a user or candidate (for the avoidance of doubt, this shall not apply to API use);
xi. promote or contain information that you know or believe to be inaccurate, false or misleading;
xii. engage in the promotion of contests, sweepstakes and pyramid schemes, without our prior written consent;
xiii. exploit people in a sexual or violent manner; or
xiv. invade or violate any third party’s right to privacy;
Please be aware that this is not an all-encompassing list of restrictions, if you breach any of these restrictions, we may revoke your license to use our website, at our discretion.
If you are a Recruiter using the site and services then you need to comply with the below responsibilities, and agree not to;
To the extent a User provides Confidential Information to the other, the recipient agrees to protect the secrecy of the discloser's Confidential Information with the same degree of care as it uses to protect its Confidential Information, but in no event with less than due care. On a User's written request, the party that received Confidential Information will promptly destroy or return the disclosing party's Confidential Information and any copies thereof contained in or on its premises, systems, or any other equipment otherwise under its control.
All content available on the website, including, but not limited to, the trademarks, logos, and service marks displayed on the website (collectively, the "Trademarks") are the registered and unregistered marks of The Moving Teacher, our affiliates, or licensors in The Australia and other countries. All Trademarks not owned by us, our affiliates, that appear on the website are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by us. Except as required under applicable law, neither the services, the Trademarks, nor any other portion of the website may be used, reproduced, duplicated, copied, sold, resold, accessed, modified, or otherwise exploited, in full or in part, for any purpose without our prior written consent.

The Moving Teacher shall not be liable for any direct, indirect, incidental, or consequential damages or loss arising out of your access to or use of this services. You acknowledge and agree that the entire risk arising out of your use of the platform, Services, remains with you to the maximum extent permitted by law. Because of the nature of our services, we wont be offering refunds, for paid services. Please be aware that refunds are only eligible for unfulfilled orders, and no refunds will be issued for any other reason. All refunds are issued at the sole discretion of The Moving Teacher. The Moving Teacher respects the privacy of children, and we are committed to complying with the European Union GDPR Children's Online Privacy Protection. This site does not knowingly collect, use, or disclose personal information from children under 18 without prior parental consent. However, we may provide our service to children under 18 years of age but under a parental guardian's supervision.
If The Moving Teacher processes personal data of California residents on behalf of the User, The Moving Teacher does so as a service provider for the purposes of the California Consumer Privacy Act (“CCPA”) and is receiving personal information from User pursuant to these Terms for a business purpose. The terms “personal information,” “service provider,” “sale,” and “sell” are as defined in Section 1798.140 of the CCPA.
The Moving Teacher reserves the right to immediately suspend or terminate its Service to any User without warning and notice for violation or breach of any of the agreement in this Terms of Service. Notwithstanding, you may terminate this agreement with The Moving Teacher, and close your Account at any time, following settlement of any pending transactions.
You agree to indemnify The Moving Teacher from any and all Losses incurred by and defend The Moving Teacher against any claim arising out of or in connection with: (i) your use of the Service, (ii) any violation or breach by you of these Terms of Service or any failure by you to comply with Applicable Laws, (iii) any dispute or litigation caused by your acts or omissions, (iv) any data, information or other content submitted by you, (v) the use of your Account, whether by your or a third party. The Moving Teacher reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify The Moving Teacher, including rights to settle, and you agree to cooperate with the defense and settlement of these claims.
These terms and conditions, services and agreements shall be governed and construed in all respects by the State of Florida laws, including the United State FTC Laws.
The Moving Teacher encourages User to leave a review and feedback; we promise to respect your feedback irrespective of the outcome, for it helps us improve on our services and make us serve you better. A User’s feedback demonstrate the overall experience with the website services. By submitting feedback, we acknowledge that we will not remove your review unless it is a violation of our Terms and conditions and you are granting us an irrevocable, perpetual, non-exclusive, transferable, fully-paid, worldwide license (with the right to sublicense freely) to use, copy, modify, publicly perform, publicly display, reformat, translate, syndicate, republish, excerpt (in whole or in part) and distribute feedback we receive from you for any purpose, including business, commercial, marketing, advertising, or otherwise.

- Recruiter Obligations
If you are a Recruiter using the site and services then you need to comply with the below responsibilities, and agree not to;
- publish Job Openings that do not correspond to the actual unfulfilled full time/part-time/hourly employment/contract positions;
- publish Job Openings with the aim of harvesting Candidates for any reason other than legitimate employment;
- publish Job Openings that direct Candidates to apply through means that are not supported by The Moving Teacher and the Website;
- publish Job Openings on behalf of an entiy without their knowledge and consent;
- request payments from Candidates;
- Confidential Information
To the extent a User provides Confidential Information to the other, the recipient agrees to protect the secrecy of the discloser's Confidential Information with the same degree of care as it uses to protect its Confidential Information, but in no event with less than due care. On a User's written request, the party that received Confidential Information will promptly destroy or return the disclosing party's Confidential Information and any copies thereof contained in or on its premises, systems, or any other equipment otherwise under its control.

- The Moving Teacher processes personal data (as such term is defined in the Data Protection Laws) which it collects as a data controller (as the term is defined in the Data Protection Laws) in the course of providing the Services. Where data is processed by The Moving Teacher as a data controller, such processing is carried out in accordance with The Moving Teacher’s Privacy Policy. The Moving Teacher processes such categories of personal data as are described in the above referenced Privacy Notices.
- The User shall include words substantially similar to The Moving Teacher’s Privacy Notice page , as well as all other provisions required for such Privacy Notice to comply with the Data Protection Laws.

- Termination

- Indemnification
